Alpena County Prosecutor Rules Deputies’ Actions in Shooting Justified

ALPENA COUNTY — The Alpena County prosecutor announced that the actions of Presque Isle county deputies in the shooting of 33-year-old Edward Fitzgerald were justified under Michigan’s self-defense laws. Fitzgerald was arraigned on Dec. 26, 2025, facing multiple charges related to the incident on Nov. 27.

Prosecuting Attorney stated that Michigan law allows individuals to use force to defend themselves or others under certain circumstances. The investigation concluded that Fitzgerald’s actions on Nov. 27 posed an immediate danger of death or great bodily harm to the deputies, thus justifying their use of lethal force.

Fitzgerald was charged with one count of assault with a dangerous weapon and four counts related to the use of firearms, specifically felony firearm charges. He also faces charges for carrying a dangerous weapon with unlawful intent, fleeing from police officers and resisting or obstructing police officers.

Following the shooting, once the threat was neutralized, deputies provided life-saving first aid to Fitzgerald, which likely prevented further harm. According to the prosecutor’s office, failing to provide immediate care could have resulted in Fitzgerald succumbing to his injuries.

A cash or surety bond of $250,000 was set for Fitzgerald’s release. His next court appearance is scheduled for Dec. 30, 2025.

Legal proceedings will continue as Fitzgerald prepares for his upcoming court date. Further details about the case may emerge during the next hearing on Dec. 30.
